Service”), you agree to these Terms of Service (“
Terms”). If you do not agree, do not use the Service.
These Terms are provided for publication alongside the Privacy Policy. Consider legal review for your jurisdictions; this is not legal advice.
1. The ServiceSumma provides a
personal web-based running diary and training log, including optional
synchronization with third-party platforms such as
Strava when you choose to connect them, and an optional
coach–athlete feature: you may
add another Summa user as your coach using an
invite code they provide, which allows that user
read-only access to
your diary within Summa; you may remove that link at any time.
Summa does not provide a user-facing option to publish your diary to
all other registered users for general browsing.
The Service is currently provided
free of charge. We may introduce
paid features or subscriptions in the future; if we do, we will inform you as required by law before those terms apply to you.
We may modify, suspend, or discontinue features
with or without notice where permitted by law. We do not guarantee uninterrupted or error-free operation.
2. EligibilityYou must be at least
16 years old. You must have the legal capacity to enter into a binding contract under the laws that apply to you.
You may
not use the Service if you are barred under applicable law.
3. Account registration and security- You must provide accurate information and keep it updated.
- You are responsible for safeguarding your password and for all activity under your account.
- Notify us immediately at pavel.olar@gmail.com if you suspect unauthorized access.
We may suspend or terminate accounts that violate these Terms or pose a security risk.
4. License to use the ServiceSubject to these Terms,
Pavel Olar grants you a
personal, non-exclusive, non-transferable, revocable license to access and use the Service for your
private, non-commercial training logging, unless we agree otherwise in writing.
You may
not:
- use the Service in violation of law or third-party rights;
- attempt to gain unauthorized access to systems, other users’ data, or the Strava API outside authorized OAuth flows;
- reverse engineer, scrape, or probe the Service except where mandatory law allows;
- use the Service to distribute malware, spam, or harmful content;
- resell, sublicense, or commercially exploit the Service without our written consent;
- use the Service in any manner that violates the Strava API Agreement or Strava’s API Brand Guidelines when Strava features are in use.
5. Your contentYou retain ownership of
your training notes and data you enter. You grant
Pavel Olar a
limited license to host, process, back up, and display
your content
solely to operate the Service for
you (including sync and storage), and —
when you choose to add a coach — to display
your diary content to
that coach in
read-only form within Summa as part of the coaching feature.
You represent that you have the rights to any content you upload and that it does not violate law or others’ rights.
6. Strava integration (third-party service)If you connect
Strava:
- Your use of Strava is also governed by Strava’s Terms of Service, Privacy Policy, and API Agreement (as applicable between you, us, and Strava).
- You authorize Summa to access Strava on your behalf only within the scopes you approve in the Strava consent screen.
- You can disconnect Strava in Summa and/or revoke access in your Strava account. After deauthorization, we will stop syncing and will delete or anonymize Strava-sourced data in accordance with our Privacy Policy and product behavior.
- Strava is independent from us. We do not control Strava’s availability, API changes, rate limits, or data model.
No confusion as to brand: Summa is
not Strava, is
not endorsed by Strava, and is an independent application. Strava® is a registered trademark of Strava, Inc.
7. Prohibited and restricted uses of Strava Data (important)When you use Strava with Summa,
Strava Data (data we receive from Strava about you) must be handled in line with the
Strava API Agreement. Among other rules (non-exhaustive):
- Strava Data is primarily shown to you (the athlete) in the Service. Exception — voluntary coach link: If you actively add another Summa user as your coach using their invite code, Summa may display your Strava-synchronized activities and diary to that coach in read-only form only within Summa, solely to provide the coaching relationship you initiated. You may remove the coach link at any time in the Service. This is not a public feed, not a listing of all users’ data, and not disclosure for advertising or resale. Summa is not a Strava “Community Application” unless Strava classifies it as such.
- Strava Data may not be sold, licensed, or disclosed to third parties for their independent use, including advertising or data brokerage.
- Strava Data may not be used for machine learning / AI model training or similar prohibited purposes under Strava’s Agreement.
- You may not use Strava Data in advertisements without Strava’s express written consent.
If you misuse the integration, we may
disable Strava features or
terminate your account.
8. Acceptable use and abuseYou agree
not to:
- harass, threaten, or harm others, including through coach–athlete interactions (e.g. misusing access to an athlete’s diary);
- upload unlawful content;
- overload or attack our infrastructure;
- circumvent technical limits or security;
- use the Service to build a product that replicates Strava’s core product or competes with Strava using Strava API Materials in violation of Strava’s Agreement.
We may investigate and cooperate with authorities regarding violations.
9. DisclaimersHealth and fitness: Summa is
not medical advice, coaching, or a substitute for professional healthcare.
Consult a physician before starting or changing an exercise program.
You assume all risks related to physical activity.
Service “as is”: To the fullest extent permitted by law, the Service is provided
“as is” and
“as available” without warranties of any kind, whether express, implied, or statutory, including
merchantability,
fitness for a particular purpose,
title, and
non-infringement.
Third-party services: Strava and other third parties are
not our agents. To the extent permitted by the
Strava API Agreement and applicable law,
third-party service providers are not liable to you through these Terms, and we
disclaim warranties on their behalf where such disclaimers are permitted.
10. Limitation of liabilityTo the fullest extent permitted by applicable law:
- We are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the Service or inability to use the Service, even if we have been advised of the possibility.
- Our total liability for any claim arising out of these Terms or the Service is limited to the greater of (a) the amounts you paid us for the Service in the twelve (12) months before the claim and (b) zero (€0), because the Service is currently provided free of charge, unless mandatory law requires otherwise.
Some jurisdictions
do not allow certain limitations; in those cases, our liability is limited to the
maximum permitted by law.
11. IndemnityYou agree to
defend, indemnify, and hold harmless Pavel Olar from and against claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from: (a) your use of the Service; (b) your content; (c) your violation of these Terms or law; or (d) your violation of
Strava’s terms or misuse of Strava Data.
12. Suspension and terminationWe may
suspend or terminate your access to the Service at any time, with or without cause or notice, where permitted by law.
You may
delete your account using the
account deletion option in the Service when available, or by requesting deletion at pavel.olar@gmail.com. Provisions that by their nature should survive (e.g. disclaimers, liability limits, governing law) will survive termination.
13. PrivacyOur
Privacy Policy explains how we collect and use personal data. It is incorporated into these Terms by reference.
14. Changes to the TermsWe may modify these Terms by posting an updated version at
https://summa.run/terms and updating the “Last updated” date. If a change is material, we will provide additional notice where required by law.
Your continued use after the effective date constitutes acceptance of the revised Terms, where permitted by law.
15. Governing law and disputesThese Terms are governed by the laws of the
Republic of Estonia, without regard to conflict-of-law principles,
subject to any mandatory consumer protection rules that apply to you in your country of residence (for example within the
EEA or
UK).
Disputes: Subject to those mandatory rules, disputes arising from these Terms or the Service shall be brought before the
courts of the Republic of Estonia (Harju County Court has general jurisdiction in Tallinn, unless another court is mandatory for you as a consumer).
The European Commission provides an
Online Dispute Resolution (ODR) platform:
https://ec.europa.eu/consumers/odr. We are
not obliged to participate in out-of-court consumer dispute resolution for the free Service, but you may use the ODR platform for information. Our contact email for consumer matters is pavel.olar@gmail.com.
Nothing in these Terms limits any
non-waivable statutory rights you may have as a consumer.
16. Open-source and third-party componentsThe Service may include open-source or third-party software governed by
their licenses.
